Terms and Conditions (T&C)

 

Article 1 - General Scope and Object of the Agreement

The following terms and conditions (T&C) govern the relationship between you as a client and Energy Collective while interacting through our website https://timebombtbt.goodbarber.app and/or our application Time Bomb TBT.

Navigating and/or interacting on our website and/or application means that you expressly agree to these T&C without reserve or objection.

Energy Collective reserves the right to modify or adapt these T&C at any time and without prior notice. These T&C are directly applicable as soon as they are published on our website and/or application and/or sent to you by any means.

Please read these Terms and Conditions carefully before using, interacting with, or accessing our website and/or application.

By agreeing to these T&C, you confirm that you have reached at least the legal majority in your jurisdiction. If you are a minor, you confirm that you have all the rights and consent from your legal representatives to use our services. If you have not reached the legal majority, then you must not use our services.

You are not entitled to use our services, website, and/or application for any illegal or unauthorized purposes.

You must not attempt to hack, alter the use or functions of our services, send viruses, or conduct any malicious attacks against our services. You must not jeopardize the integrity of our services.

Article 2 - Content and Intellectual Property

The content provided in our services might be accessible for free or not. Some content might require you to log in or have a valid paid subscription (in-app purchases, restricted content, or sections).

If some content requires you to have an account or to be registered, please refer to Article 4 “Registration Process” for details on accessing our services.

The content of our services is intended for personal, non-commercial use. All materials available on our services are protected by copyrights and/or intellectual property rights.

Additionally, some content might be protected by other rights such as trademarks, patents, and trade secrets.

You are not allowed to reproduce, modify, copy, paste, translate, sell, exploit or transmit any of the content, text, photos, audio content, or any other materials available on our services without our express permission.

Article 3 - Subscription and Payment (Duration, Recurring Payment, Auto Renewal)

Price

The applicable subscription fees are shown before concluding the ordering process.

Please check how the Apple Store and the Google Play Store handle tax management and pricing.

Any changes in taxes will be directly applicable to subscriptions.

Energy Collective reserves the right to change any fee or tariff at any time and without prior notice.

Payment and Fees

Available payment methods will be shown to you upon subscription. Electronic payment options will be shown only if available.

Your banking details and credit card information are encrypted and never stored on our website and/or application, as we use third-party solutions to process your payments.

Energy Collective reserves the right to modify any fees at any time. If you do not agree with the price change, you may stop using our services before renewal occurs.

If you have subscribed through a third party such as Google Play, Apple App Store, or any other third party, these Terms and Conditions may not apply to you. In that case, your contract will be with the third party and not with Energy Collective.

Our company will have no liability or responsibility regarding any issues or difficulties regarding in-app purchase transactions, as they are conducted through third-party platforms.

Restoring Your Subscription, Digital Content, or In-App Purchases

If you have made in-app purchases through a third party, you might be able to restore your previous purchases through a link within our application and/or website.

Article 4 - Registration Process

Energy Collective may require you to register to access some parts or the whole application and/or website.

Each registration is intended for one user only, and you are prohibited from sharing your credentials or account with anyone.

We may cancel or suspend your access to our services if you share your credentials.

Please notify us immediately at info@powerfocusluck.com if you suspect your credentials are compromised.

Registration

If registration is required, the client must create an account by filling in the registration form available on our website and/or application, choosing a login and password linked to a valid email address.

The client agrees to keep their credentials confidential and secure at all times.

Energy Collective will not be held liable or responsible for any

unauthorized use, modification, or access to the client’s account, even if fraudulent access is made using the client’s account or banking details.

Signing In with Third-Party Authentication

Third-party authentication services, including but not limited to “Sign in with Apple”, Facebook, and Twitter authentication, may be implemented within our application and/or website to assist you in signing in or creating an account directly.

You can choose to register an account via the embedded registration form or use third-party authentication mechanisms. These third-party providers are not affiliated with Energy Collective, and it’s your responsibility to review their privacy policies and terms.

By using third-party authentication, you are allowing those applications/platforms to access some of your personal data. The relationship between you and the third-party platform is outside Energy Collective's control.

If you are unsure about how your data is managed while using these authentication services, you should use our embedded account registration.

Article 5 - Warranties

The content provided by our services is offered to the user “as is” and “as available.” We cannot guarantee that the content provided will be accurate, true, or error-free. The user accesses our content at their own risk.

We will not be held responsible for any inaccurate or misleading content on our services.

Article 6 - Content Moderation and User-Generated Content

If you upload, post, or submit any type of content on our services, you represent that you have all necessary legal rights to do so.

You shall not publish, distribute, or upload content that is abusive, obscene, illegal, or defamatory. Additionally, you shall not impersonate others or use a fake identity when using our services.

You shall not use our services to transmit malware, viruses, or any harmful software. Users will not threaten, harass, or abuse other users, nor will they use discriminatory language. Hate speech of any kind is prohibited.

Energy Collective reserves the right to delete, modify, or censor user-generated content and accounts if any of these rules are violated without notice, and the client will not receive compensation for such actions.

Article 7 - Liability

Energy Collective will not be liable for network disruptions, viruses, unauthorized access, fraudulent use of payment methods, or other technical issues.

Article 8 - Third-Party Links and External Sources

Some content on our site may include materials from third parties. Third-party links on our services may direct you to websites that are not controlled by us. We are not responsible for the content or accuracy of third-party websites and are not liable for any damages incurred from accessing such links.

Article 9 - Disclaimer of Warranties

While using our website and/or application, you agree that we will not be liable if data on our services is not accurate or complete. The information provided is for illustrative and informational purposes only. Further advice should be sought before making serious decisions. You use our services at your own risk.

Energy Collective reserves the right to modify or delete any content on our services without prior notice, but does not have an obligation to update any content.

We do not guarantee that the use of our services will be uninterrupted or error-free. The client agrees that we can change or remove services without prior notice.

Our services are provided “as is” and “as available” without any warranties.

In no event will Energy Collective be liable for any loss or damages of any kind, including but not limited to, loss of profits, revenues, data, or savings.

Article 10 - Indemnification

As a client, you agree to indemnify, defend, and hold harmless Energy Collective from any claims made by third parties due to your breach of these T&C.

Article 11 - Severability

If any part of these T&C is found to be unlawful or unenforceable by a competent jurisdiction, that provision shall be enforceable to the fullest extent allowed by law. The invalidity of any provision shall not affect the validity and enforceability of the remaining provisions.

Article 12 - Termination

All obligations and liabilities accrued before the termination date will survive the termination of this agreement.

These T&C are effective unless terminated by Energy Collective or you, the client.

You may notify us if you no longer wish to use our services, or you can simply stop using our services.

Energy Collective may terminate this agreement at any time without prior notice. You will remain liable for any amounts due to Energy Collective.

Article 13 - Governing Law and Venue

These T&C are governed by the laws of British Columbia, Canada. Any issues arising from these T&C will be submitted to the relevant jurisdiction.

The relevant jurisdiction is the courts of Victoria, British Columbia.

Cancellation and Refunds

If you cancel your subscription, the cancellation will apply only to future

charges associated with that subscription. You can notify us of your cancellation at any time, and this cancellation will take effect at the end of your current billing period.

You will not receive a refund for the current billing cycle, but you will continue to have access to all the services and benefits until the end of that period.

Depending on where you reside, you might be eligible for a partial or full refund based on applicable legislation and regulations.

Energy Collective reserves the right to issue refunds or credits at our sole discretion.
